Background checks are a helpful tool for vetting candidates, and gaining insight into potential issues that candidates may not have disclosed. But they can be an Achilles heel for employers, especially when you believe you finally found the perfect candidate for a tough to fill the position, only to discover that the person’s background doesn’t meet the requirements of the job. If you decide not to hire the candidate, you will need to follow both company policy and the law in issuing your hire decision. Results of a background check aren’t necessarily a reason not to hire an otherwise excellent candidate, though, so this could lead to a tough decision. Here’s what you need to know.
What To Do When a Candidate’s Background Check isn’t clear
The first thing you will need to consider is the reason the person was flagged. Background checks are broad by design, and not all problems are necessarily an issue for all employers.
- Criminal background
- Education verification
- Credit check
- Driving record
- Employment history
- Drug test
Your background checks may not cover all these topics. For example, credit checks are highly regulated, and you may not be able to pull a credit report except for managerial candidates or those applying for a job in finance. Likewise, a driving record may not apply if the position does not involve operating a motor vehicle.
If a candidate has red flags on their background check, you’ll need to make sure you follow all relevant laws, guidelines, and policies. At a minimum, you will need to send the candidate an adverse action notice if you decide not to hire them solely based on their background check.
This process is highly regulated by law, and the laws vary by jurisdiction. You will need to work closely with your attorney to make sure you follow both the letter and the spirit of the law.
